Johanson Dielectrics has achieved its first in a series of qualifications of its line of X2Y® Low Inductance EMI Filter and Power Bypass Capacitors against the Automotive Electronic Council’s specification for component stress testing known as AEC-Q-200. Law360, Los Angeles (August 08, 2013, 5:01 PM ET) -- X2Y Attenuators LLC has taken its infringement case against Intel Corp., Apple Inc. and Hewlett-Packard Co. to the Federal Circuit, contending the U.S. International Trade Commission relied on faulty claims constructions when it found the companies' microprocessors and computers didn't infringe three of its patents.

In an Aug. 5 brief made public Thursday, X2Y said the ITC had erred in construing the terms "electrode" and "perimeter edge" in a manner inconsistent with specifications describing its three asserted patents. The ITC on Feb. 15 issued a decision... Visit Law360 to view full article.

02/16/2013 - SUMMARY OF THE ITC COMMISSION'S RULING

The International Trade Commission issued a notice on February 15, 2013 indicating that it had elected to review the 337-TA-781 Initial Determination in part. Although the Commission found no violation, it reversed the majority of the ALJ's findings that were adverse to X2Y and confirmed that X2Y's patents are valid.

The Commission's finding of no violation now rests on the Commission's construction of only two disputed Claim terms, which the Court of Appeals for the Federal Circuit will review without deference to the Commission's ruling.

X2Y is confident that the Federal Circuit will reverse the Commission's construction of these terms and looks forward to raising these issues on appeal. A summary of the specific findings by the Commission is set forth below:

  1. The Commission reversed the ALJ's finding that 9 of 11 asserted Claims were indefinite based on the word "portion";
  2. The Commission reversed the ALJ's finding that all 11 asserted Claims required a structure using a "capacitance requirement";
  3. The Commission vacated the ALJ's invalidity findings under X2Y's Claim constructions, confirming that X2Y's patents remain valid;
  4. The Commission declined to review the ALJ's finding that X2Y demonstrated a domestic industry through the investments of its licensee (Johanson Dielectrics);
  5. The Commission vacated the ALJ's domestic industry findings relating to research and development investments as non-dispositive in light of the conclusion that a domestic industry exists due to the investments
  6. The Commission declined to review the ALJ's Claim construction of the terms "electrode" and "perimeter edge," resulting in a finding of non-infringement.

Conclusion:

The Commission ruling terminates the 781' Investigation with finding of "no violation" due to "non-infringement" of the accused structures based *ONLY* on the constructions of the (2) terms "electrode" and "perimeter edge."

The Commission's ruling of no violation is now ripe for appeal to the Court of Appeals to the Federal Circuit.

12/17/2012 - X2Y Comments on Articles

In the wake of the Initial Determination (ID) in the 337-TA-781 (781) Investigation before the International Trade Commission (ITC), several press reports have incorrectly stated that X2Y's patents have been ruled ‘invalid'. In fact, the ID contains no determination as to the validity of any patent.

X2Y's patent portfolio contains hundreds of patents and thousands of claims relating to its technology; any statements about claim validity or invalidity contained in the ID are in the context of a Section 337 investigation and refer only to the initial determination regarding the (11) specific claims asserted in the 781 investigation. X2Y Attenuators, LLC will request review of the initial determination of these claims by the Commission.

12/14/2012 - X2Y Comments on Initial Determination

X2Y is pleased the Initial Determination finds that X2Y has demonstrated that a domestic industry exists under the Section 337 statute and that X2Y has valid claims covering its innovative technology. These findings serve as an important message to small business innovators and confirms X2Y patents rights. X2Y, however, is disappointed with the bulk of the decision relating to validity of certain claims and infringement and will request the Commission's review of at least those issues. X2Y remains confident that the Commission will protect true innovation regardless of the size of the innovator and will continue to vigorously enforce its intellectual property rights against these infringers.

08/12/2012 - International Trade Commission (ITC), X2Y Comments on ITC letters

As reported by Bloomberg in Intel's Trade Agency Patent Case Cited for U.S. Jobs Risk and by Law360 in Sens. Urge ITC To Side With Intel, HP On Processor Patents , Members of Congress have submitted letters to the U.S. International Trade Commission about X2Y. The following are X2Y's comments:

X2Y is aware that Members of Congress from California, Oregon, Arizona, Massachusetts, and New Mexico have submitted statements to the International Trade Commission encouraging the Commission to refuse to issue an exclusion order against Intel in the event Intel is found to infringe X2Y's patents. We are certainly pleased that Members of Congress have taken an interest in this dispute, but it appears that they were not provided with complete information. X2Y, contrary to statements made in the Members submission to the ITC, licenses its technology to a number of manufacturers that include X2Y's technology in their products.

X2Y was approached by Intel over a decade ago, and explained how X2Y's technology would improve Intel's products if Intel wished to take a license. Intel did not take a license, but appears to have adopted X2Y’s technology anyway. X2Y is willing, and has always been willing, to provide Intel with a license at a reasonable rate similar to that paid by its other licensees for their manufacture and use of X2Y technology. X2Y cannot, however, allow any company to use its technology for free.

X2Y does not seriously believe that the Members of Congress from the states listed above think that it is a good idea for a large company -- even one as powerful as Intel -- to be free to steal the technology of others. If Intel is found to be infringing X2Y's patents, it trusts that the Commission will exercise its authority to stop Intel's unlawful activities. The Members of Congress have expressed concern that an exclusion order would somehow result in job loss or other harm to the economy. Intel, however, can easily avoid any harm to itself, its employees, and the US economy by simply taking a license to continue its current use, by redesigning its products to remove X2Y's patented technology, or by moving all of its operations into the United States.

2/19/2009 – X2Y Capacitor Solution for Amplifier Input Filtering

X2Y capacitors are fast becoming the filter of choice for engineers that need a simple, compact solution that provides superior RF filtering in amplifier circuits.

Following the release of the Texas Instruments video Analog eLab – Improved INA Input Filter, Bill Klein in conjunction with Johanson Dielectrics Inc. has written a technical note now posted on Johanson’s website called Improve Instrument Amplifier Performance with X2Y® Optimized Input Filter. 10/21/2008 -Samsung Electro-Mechanics Mass Produces X2Y capacitors

Samsung Electro-Mechanics has started mass production of X2Y capacitors, which incorporate patented technology from X2Y Attenuators LLC.

The 1st line up plan of X2Y capacitors includes 11 products in (1608) size that range in capacitance from 1nF- 1uF in X7R and X5R dielectric.

The 2nd line up plan will expand the capacitance range of 0603 (1608) size to 2.2uF and includes larger size 0805 (2012) products in capacitances ranging from 22nF - 2.2uF, and 1206 (3216) sizes in capacitances from 47nF - 10uF. The larger 0805 and 1206 size products are now under mass production verification with mass production planned for Dec. 2008.

07/10/2007 - Samsung Electro-Mechanics Announces Agreement to Make X2Y® Capacitor Technology

On July 10th, Samsung Electro-Mechanics signed an agreement with X2Y Attenuators LLC to produce and sell capacitors that incorporate the patented X2Y® Technology. This agreement marks the start of a cooperative effort to bring Samsung Electro-Mechanics’ high-capacitance X2Y capacitors to market to meet increasing global demand.

X2Y® bypass capacitors are one tenth the inductance of conventional capacitors and have two main application uses: superior EMI suppression to help customers meet EMC Compliance, or low inductance bypassing to maintain Power Integrity for Integrated Circuit (IC's) devices such as CPUs, ASICs, FPGAs, etc. In both application uses, X2Y's enhanced capability can remove as many as 5~8 passive components used for noise reduction.

05/07/2007 - X2Y® for Amplifier Filtering

X2Y capacitors are used extensively for amplifier filtering and decoupling. In either application use, X2Y replaces multiple components multiple passive components. In a previously published article, it was shown that X2Y could replace three tight tolerance film capacitors with a single component to lower system cost. This information was later published by engineers at Analog Devices Inc. in A Designer’s Guide to Instrumentation Amplifiers, 3rd Edition , also published on the company's website. In a new article titled Interference Suppression Using a Balanced MLCC , recently published in Interference Technology by publisher rbitem.com , X2Y® is also shown to be able to replace a large common mode choke, which is also commonly used as an input filter for RFI suppression for Instrumentation Amplifiers. 01/13/2006 - Johanson Dielectrics Increases X2Y® Product Offering

X2Y licensee Johanson Dielectrics (JDI) now has sample stock of X2Y® 0603 0.1uF X7R 6.3V parts for use in IC bypass applications. The JDI parts are featured in a new video about X2Y® Technology called “Low Inductance Capacitor Packages”, produced by Signal Integrity Expert Dr. Howard Johnson of Signal Consulting Inc. The DVD will be distributed at X2Y’s booth #128 during DesignCon 2006 ,February 6-9, at the Santa Clara Convention Center in Santa Clara, California.

The SigCon production will demonstrate how just 16 of JDI’s X2Y® 0603 caps (using 96 vias) were used to achieve comparable circuit performance when replacing 58-0402 caps (using 232 vias) when bypassing a Xilinx® Virtex 4 FPGA. The result is dramatic system cost savings through passive component reduction, fewer vias to reduce blocked routes, and a substantial savings in assembly costs associated with capacitor placement and soldering.

X2Y licensee Johanson Dielectrics has just developed a new 0402 size 0.012uF X2Y® part in X7R dielectric for use in IC bypass and other applications where miniaturization is required. Other application uses for this part include filtering in implantable medical devices, microphone headsets and hearing aids. Full commercialization is slated for Q1 of 2006.
